Sex Abuse Laws in Maryland
As of October 1 of 2023, Maryland has a new statute of limitations for child sex abuse cases. For the victims who have been denied justice because they were too old to speak up for themselves, now is the time to act. In 24 other states, there is now what is known as a “look-back window”, or a revival period. This is a finite period of time for survivors to make a claim from many years prior. Maryland’s window of time is permanent. So, to be clear, there is no longer a civil statute of limitations for sex abuse acts in Maryland.
Governor Wes Moore of Maryland is quoted as saying, “there is no statute of limitations on the hurt that endures for decades after someone is assaulted. There is no statute of limitations on the trauma that harms so many still to this day, and this law reflects that exact truth.”
Unfortunately, Maryland is the only state in the country that provides a limit as to how much you can recover. But, this does not mean you should not be able to recover the maximum amount if your injuries warrant. There is a limit of $1.5 million for non-economic damages like pain and suffering. But, for something like medical expenses which, generally, will appear in the form of therapy sessions, there is no cap. While the caps are unfortunate, there is nothing we can do at this time as these laws are written in the statute and are binding. Regardless, our Maryland child sex abuse lawyers fight to maximize your ultimate recovery.
